BRITISH SQUAD MEMBER AGREEMENT

 

 

 

 

 

 

This is a legally binding document, which you should read carefully so as to understand it and if necessary seek independent legal advice. British Equestrian Vaulting would be happy to discuss the detail with you prior to signing it, should you require clarification on any matters. This Agreement should be read in conjunction with the BEF Rule Book and any definitions referred to therein shall apply to this Agreement.

1. This Agreement sets out the basis upon which I am selected as a member of a Squad to train and compete. I accept that my membership of a Squad is and will remain conditional on my eligibility to compete for Great Britain.

 

2. I hereby declare that I am eligible to compete for Great Britain and that I will forthwith inform BEV in the event that I become aware of any change to this position.

 

 

3. This Agreement will continue unless terminated by either party but in the event of termination I agree that the obligations in Paragraph 5 below will continue to be binding upon me.

 

 

4. Squad Member Benefits

As a member of the Squad I am entitled to receive the following benefits:

 

a) Information covering preparation for suitable competitions.

 

b) Administration of my entry and other administrative services at the competition.

 

c) Squad uniform and competition apparel and other items of clothing and equipment as provided by official suppliers, if any.

          

 

5. I hereby agree that I will:

 

5.1 Observe and comply with this Agreement, the BEV Rules, the BEF Rules and the Rules of the FEI at all times.

 

5.2 Be subject to the reasonable control, management and direction of any Official (as defined in the BEF Rule Book) and in particular the Chef de Mission.

 

5.3 Conduct myself in a proper manner so as not to bring myself, BEV Ltd. The BEF, or the Squad of which I am a member into disrepute.

 

5.4 Conduct myself in such a manner so as to obtain and maintain my best possible physical fitness and health to carry out my responsibilities to the Squad of which I am a member for the best interest of the team.

 

5.6 Attend any Squad function reasonably requested by BEV.

 

5.7 Use my best endeavours to represent the Squad and/or the BEF and any member of BEF (i.e. BEV Ltd.) to the best of my ability in the pursuit of success in competition.

 

5.8 That in relation to myself or any horse or horses to disclose to BEV Ltd. In writing any illness, injury or condition that may prejudice my proper participation or performance in competition AND to relinquish my position in the Squad forthwith if, in the opinion of the Chef/ Selectors after consultation with the Sports Science and Medical Director and/or Director of Equine Sports Science and or the properly appointed Veterinary or Medical person for that competition, I am unable to perform at the competition to the best of my ability.

 

5.9 That in relation to myself and any horse or horses I further agree to disclose to BEV in writing any medication that I or any horse or horses may be using, and not to take, administer or have administered any unapproved medication, drugs or substance.

 

5.10 The Squad Official designated by BEV (normally the Chef de Mission or his delegated Communications Coordinator) shall be the spokesman on all matters concerning the Squad and I will not make any comment or representation of any kind on any matter concerning or relating to the Squad or the BEV to the media without first obtaining the written permission of the BEV. On any other matter the Rider may communicate directly with the media but they do not have to communicate with the media and cannot be compelled to do so.

 

5.11 I agree to be responsible for the conduct of any groom, assistant, member of my support team and any person connected to me as a Rider and to ensure that they comply with the terms of this Agreement at all times either during a competition or otherwise.

 

6. Material breach of any part of this Agreement

6.1 Should I commit a material breach of any part of this Agreement the BEV may in their absolute discretion

a) Terminate my membership of the Squad and or

b) Exclude me from a competition.

 

However, before an Official imposes any or all of the above provisions I shall be given an opportunity and reasonable time to state a case in defence of any allegations made against me, and to be represented in making my defence.

 

6.2 Notwithstanding any action by the BEV pursuant to Clause 6. 1, the obligations upon me under the Agreement will continue to be in full force and effect, even following the termination of this Agreement.

 

6.3 I agree that failure by BEV and or the BEF to enforce at any time any of the provisions of the Agreement shall not be construed as a waiver of such provision and shall not preclude the subsequent enforcement by BEV of this Agreement.

 

 

7. Release and Indemnity

 

7.1 I hereby agree and acknowledge that I take part in the competition at my own risk and that BEV and the BEF shall not be deemed responsible or liable whether in contract and/or negligence or under any statute or otherwise for any injury, illness or mishap whatsoever and howsoever it may arise which may be suffered by me or be sustained to property belonging to me during the term of this Agreement, unless it arises as a direct result of a deliberate and wrongful act or omission of BEV and or the Sport their officials and staff.

 

7.2 I agree and acknowledge that I hereby indemnify and will at all times hereafter indemnify and keep the BEV and the Sport fully indemnified from and against all actions, suits, causes of action, proceedings, demands, costs and expenses whatsoever which may be taken or made against the BEV any of its members or which may be incurred or become payable by the BEV or any of its members as a consequence of my misconduct.

 

7.3 I agree to be responsible for obtaining insurance cover for my own benefit and for my horse to include, by way of example only, any liability to third parties, losses arising for injury, loss or damage including consequential loss and loss of earnings to myself

 

8. Should any provision of the Agreement or the application thereof be held invalid or  unenforceable by a court or competent jurisdiction then the remainder of this Agreement and the application thereof other than those provisions which shall be held invalid or unenforceable shall not be affected thereby and shall continue to be valid and enforceable to the fullest extent permitted by the law or equity.

 

9. Dispute Resolution

 

9.1 If any dispute or difference arises between the parties to this Agreement in relation to this Agreement and its provisions, application, interpretation or in any way connected with this Agreement made under or in consequence of this Agreement the parties agree that they will:

 

a) First, use their best endeavours to resolve any difference or dispute by agreement between them by discussion or negotiation.

 

b) If agreement cannot be reached to submit the dispute for determination by the BEV and then the BEF Appeals Panel, to be made up of BEF Board appointed Stewards

 

c) If agreement cannot be reached to submit the dispute for exclusive and final determination to the Sports Dispute Resolution Panel (SDRP). I agree to undertake and abide by the provisions of the said Panel and to execute in good faith any decisions of the tribunal.

 

9.2 For the avoidance of doubt, any matter relating to a breach of the BEF Rules by the Rider shall be dealt with under BEF Rules by the Stewards of the BEF.

I ACKNOWLEDGE that I have read and understood the above Terms and Conditions in consideration of your accepting my son/daughter as a member of the Squad. I accept the said Terms and Conditions and agree to be bound by the provision of this Agreement as if I were a Rider.
